LONE STAR IRRIGATION – TERMS & CONDITIONS
(042026)

SERVICE TERMS SUMMARY (PLAIN ENGLISH)

Irrigation systems are underground, and additional issues may appear after repairs. Estimates are based on visible conditions only and may change if hidden issues are found. Tree roots may need to be cut, which can damage or kill the tree. We are not responsible for landscape, soil, or property damage caused by leaks or repairs. Payment is due upon completion before the technician leaves, and all work must be inspected while the technician is on site. Additional issues or return visits may require additional charges.

By approving work, you agree to the full Terms & Conditions below.

SECTION 1 – SERVICE & REPAIR TERMS

We diagnose and repair irrigation systems and do not provide landscaping, plumbing, or restoration services unless specifically stated. A service call fee is required and covers travel, evaluation, and basic diagnostic time only. It does not include repairs, labor, or materials, and additional work requires approval.

Because irrigation systems are underground, estimates are based on visible conditions only. Unknown factors such as hidden damage, prior repairs, root intrusion, and system layout may require additional work. Restoring system operation may reveal additional issues that were not visible during initial diagnosis. These are considered separate repairs and are not included in the original scope.

Repairs may require digging and cutting through roots or other obstructions. WARNING: Cutting roots—including major or structural roots—may stress, damage, or kill trees over time. By approving work, the customer accepts this risk and authorizes necessary root cutting. We are not responsible for damage to trees, landscaping, or surrounding property.

We are not responsible for pre-existing conditions, system defects, age-related failures, or issues resulting from prior installation. We also are not responsible for erosion, soil movement, lawn damage, concrete damage, or interior/exterior damage caused by leaks or system failures.

Underground conditions, including pipe routing and wiring, cannot be fully verified. Turning on or repairing a system may expose hidden leaks, weak components, or failures caused by existing system condition or pressure changes. Electrical and controller issues may be intermittent or require replacement rather than repair.

We provide a one (1) year limited warranty on workmanship and materials for repaired components only. This warranty does not cover other system components, pre-existing issues, weather damage, misuse, or normal wear and tear.

Payment is due upon completion and prior to departure. Customers must inspect work and request any adjustments while the technician is on site. If the customer is not present, the work is considered accepted and payment remains due. Return visits may incur additional charges unless related to a valid warranty issue.

The person requesting service must have authority to approve work and accept financial responsibility. If no decision-maker is present, work may proceed as authorized or be paused. Customer must provide safe and unobstructed access and secure pets. Service calls are intended for customers seeking repair; consultation-only requests may result in additional charges. We are not responsible for water usage or utility costs.

SECTION 2 – INSTALLATION / CONSTRUCTION TERMS

Installation, upgrades, and system modifications are subject to underground conditions that cannot be fully known prior to excavation. Additional labor or equipment may be required due to rock, caliche, root intrusion, or difficult soil conditions.

Standard pricing assumes normal trenching conditions. If trenching cannot be completed using conventional equipment due to hard soil, rock, or heavy root density, additional methods such as rock saw cutting, specialized equipment, or increased labor will be required and billed separately.

Customers are responsible for disclosing any private or unmarked underground items not identified by utility locating services, including irrigation lines, drainage systems, wiring, or other buried improvements. We are not responsible for damage to unmarked, improperly marked, or undisclosed underground items.

Excavation will disturb soil and landscaping. It is common for trenches to settle after backfill, which may occur weeks or months later and may require additional topsoil or grading. This is not included in the scope of work. We do not provide final grading, landscaping restoration, sod, seed, or post-settlement corrections.

Installation work may require cutting tree roots. WARNING: This may damage or kill trees over time. We are not responsible for tree damage, decline, or structural instability.

Customers must provide continuous and uninterrupted access, water supply, and electrical power (unless otherwise specified). Interruptions may result in additional charges. Any changes or additions to the project will result in additional cost.

We provide a one (1) year limited warranty on workmanship and materials installed by us. This does not cover weather damage, misuse, normal wear, soil movement, or existing system components.

SECTION 3 – FINANCIAL & LEGAL TERMS

Payment terms require non-refundable deposits and full payment upon completion. Late payments may incur fees and may be sent to collections after 15 days.

By requesting service, the customer confirms they have authority to approve work and accept financial responsibility. Disputes regarding authority or ownership do not delay payment obligations.

To the fullest extent allowed under Texas law, liability is limited to the amount paid for services. We are not responsible for indirect, incidental, or consequential damages.

Customer agrees to indemnify and hold Lone Star Irrigation harmless from claims related to site conditions, undisclosed utilities, or work performed in accordance with these terms.

We may take photos or video for documentation, training, and marketing purposes.

These terms are governed by the laws of the State of Texas.
